A key interview with the accused killer of a school girl who was raped and strangled in a shopping centre toilet could be barred from court because the suspect was not offered a lawyer.
Legal representatives for Dante Wyndham-Arthurs, 22, who has pleaded not guilty to killing eight-year-old Sophia Rodriguez, claim the video is inadmissable and should not be shown to a jury because detectives ignored his request for a solicitor.
Defence lawyers are expected to challenge the legality of the interview when the case returns to the Supreme Court later this year, according to The Australian newspaper.
It is the second time a case against Wyndham-Arthurs has been jeopardised by questionable techniques.
The part-time shop worker was arrested in June last year, 24 hours after Sophia was raped and strangled inside a disabled toilet while shopping with her family.
In 2003, Wyndham-Arthurs was charged after attempting to strangle an eight-year-old girl during a sex attack in a park.
However, the case was dropped after concerns were raised about bullying by police during an interview with the then 18-year-old.

Sorry, should have left my comment here about the case. You can’t tell me that a man charged with the rape of an 8yr old girl in 2003, has his case thrown out due to police bullying, only to rape, murder & mutilate an little 9yr old girl, and it could happen again? Our laws need changing if this is the case. We cannot worry about what Britain thinks! Our government needs to stand for the Australian people who elected them, no stand by an allow the British government to dictate to us.
He has done this more than once before and got away with it thats for sure
